General and Scope of Application

These general terms and conditions apply to all business relationships between the company Home 24 (hereinafter referred to as 'Home24.ae') and its customers. By registering with Home 24 and checking the box "I have read and accept the terms and conditions," the customer acknowledges these general terms and conditions in the version valid at the time of registration.

These terms and conditions apply to all purchases made in the Home 24 shop, provided that Home 24 does not use a different version of terms and conditions at the time of ordering. All deliveries, services, and offers by Home 24 are made exclusively based on these terms and conditions. Any conflicting, deviating, or supplementary general terms and conditions shall not become part of the contract, even if known, unless their validity is expressly agreed to in writing.

Contract Conclusion

The presentation of our range in the online shop does not constitute an offer within the meaning of the UAE Commercial Transactions Law and is subject to change without notice and non-binding. Changes (e.g., in weight, dimensions, color, and shape) remain reserved to a reasonable extent.

Orders for the products offered in the shop can be placed via the internet. By submitting an order, the customer makes a binding offer to conclude a contract. Confirmation of receipt of your order will be sent immediately after the order has been submitted via an automated email. The purchase contract is concluded with this email confirmation.

Cancellation Policy, Cancellation Consequences

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party named by you, who is not the carrier, takes possession of the goods.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including the delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us.

You will bear the direct cost of returning the goods. The costs amount to 646 AED per cubic meter, but at least 646 AED.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the delivery of goods:

• That are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
• That can spoil quickly or whose expiration date would quickly be exceeded.
• Sealed goods that are not suitable for return for reasons of health protection or hygiene if their sealing has been removed after delivery.
• Goods that, after delivery, have been inseparably mixed with other items due to their nature.
• The delivery of alcoholic beverages, whose price was agreed upon at the time of the conclusion of the contract, but which can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on fluctuations in the market.
• Audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.
• The delivery of newspapers, periodicals, or magazines, except for subscription contracts.

Commercial and Self-Employed Customers

The Right of Withdrawal, Consequences of Withdrawal applies only if the customer acquires the goods and/or services as a consumer. The customer is considered a consumer if they acquire goods and/or services for a purpose that cannot be attributed to their commercial or independent professional activity.

Prices

The prices at the time of ordering apply. All prices include VAT. Prices are excluding shipping costs.

Delays and Impossibility of Delivery

Specifying certain delivery periods and dates is subject to the condition that we ourselves are supplied on time and correctly. Home 24 is entitled to partial deliveries to a reasonable extent.

Reservation of Ownership

The goods remain the property of Home 24 until full payment is received. This follows UAE property and commercial law.

Warranty

In deliveries to consumers, the UAE Federal Law on Consumer Protection applies without restriction.

Liability for Damages

Home24 is liable for damages to the customer caused by Home 24, legal representatives, senior executives, or agents, intentionally or through gross negligence.

Irrespective of the degree of fault, Home 24 is liable for damages resulting from the breach of essential contractual obligations, in the event of a breach of warranty undertaken by Home 24, as well as in the case of fraudulent deception. Essential contractual obligations are those whose fulfillment characterizes the contract and upon which the customer may rely.

In cases other than those mentioned, Home 24's liability – regardless of the legal grounds – is excluded. This exclusion of liability does not affect the user's claims for damages resulting from injury to life, body, or health caused by a breach of duty by Home 24.

Except in cases mentioned above, claims for damages are limited to the foreseeable, contract-typical damage.

Data Protection

Information on data protection can be found in our privacy policy, in compliance with UAE Federal Law No. 45 of 2021 regarding the Protection of Personal Data (PDPL).

Dispute Resolution

We are not obligated to participate in a dispute resolution procedure before a consumer arbitration board and generally not willing to do so.

Final Provisions and Applicable Law

If any provision of these General Terms and Conditions is or becomes invalid, this shall not affect the validity of the remaining provisions. The statutory regulation shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Applicable law is UAE law. The courts of Ras Al Khaimah shall have jurisdiction for any disputes arising from this contract.
